Legal Question in Real Estate Law in Florida
My ex husband wanted our house which I agreed to give him. In the divorce agreement, I agreed to stay on the mortgage for him for 5 years, in which time he would need to sell or refinance it in his own name. And, in the divorce agreement, it states that he can not hold me financially responsible for the mortgage, taxes, insurances, etc. I just pulled my credit report because I am interested in purchasing a home, to find that he has not made a payment in the past 4 months, and that he is letting the house go into foreclosure, and it is showing negative on my credit.

He may be in violation of the divorce decree, but since the lender was not a party to it, they can still hold you liable.
