Legal Question in Real Estate Law in Florida
Illegal rental increase?
Help! I have an oral lease with my landlord payable month to month. I currently pay $475 per month. I have never been late. Come to find out, the rental is being foreclosed on. I found this out on my own accord and was served papers myself as ''jane doe''. He has not paid the mortgage since i have been living here. I called him today to confront him about it, and he used a couple of expletives. Hours later, i recieved a notice on my door from him saying my rent will be increased to $625. Is this legal or retaliatory? Is there a 30 day notice clause for notifying a rental increase? Can he do this if he is in foreclosure? If i dont pay, can he evict me while the condo is foreclosure? Please reply promptly if possible!

Re: Illegal rental increase?
The best advice I can give you is start searching for a new place to live immediately. If you have a security deposit in place, let that cover your last month's rent and find yourself another apartment. It is obvious that your landlord will not cooperate with you and has every incentive to bleed you dry in order to get his hands on additional money to cover his own problems with the mortgage lender. Don't waste money fighting a worthless battle. Just pack up and move. Good luck.
