Immenent Domain

The city wants to purchase a 500 Sq. ft. permanent easement behind our house. They started out by offering us $1200. We told them no and countered with $4000 and theyve countered with $3000. We dont really want to sell for less than 4000 but we are concerned about what will happen when it goes under immenent domain. They say its only appraising at $1200. We dont want to get stuck with a low amount when they make us sell. How does this usually work and what do you think we should do?

Florida law pays for an attorney and appraiser in all condemnation cases. 99% of all attorneys who practice this area of law will agree not to charge you for their help beyond the fees paid by the State. It NEVER makes sense not to use a lawyer in this area where the legal fees are paid by the condemning authority and do NOT reduce your payment.

You can have your property appraised with & without the easement. You will then know its value.
