Legal Question in Real Estate Law in Florida

Improper condo lien

Assoc. attorney has liened my unit. Upon contesting and producing copies of checks, he admits that all payments have been. He refuses to release lien. Some of the funds had been applied to a unit which I had sold. New owner has also made same payments on condo. Members receive NO statements. Mgmt company refuses to send financials requested by State of Florida. What is my next step ??

Re: Improper condo lien

Write the attorney a certified letter confirming everything that you said, and showing that the payment was incorrectly applied, and that if they do not remove the lien, and provide you with a copy of the recorded release within 7 days, then you will hire an attorney and sue him/her personally and the association for slander of title and for filing a fraudulent lien. IF they still fail to remove the lien then a lawsuit may be necessary.

Good Luck,

Randall Gilbert
