Legal Question in Real Estate Law in Florida

inherited properety

Property was left equally to three siblings.

One wants to sell their part.

The other two are unable to buy that part.

Can the person wanting to sell, force the sale of all of the property inorder to benefit from their inheritance.

Re: inherited properety

The quick answer is yes. A joint tenant may force the sale of jointly owned Florida real property by filing an action for partition. The Court will order a sale, subject to claims of the parties, and a division of the proceeds, unless the property is easily divisible. Since property is seldom divisible, a partition sale is likely. Contact an attorney to file the action.
