Joint mortgage one party still lives there, behind on payments and does not want

I am the joint owner on a home where the other party still lives. Other party late on payment almost to forclosure. Other party found a buyer but now does not want the split the profit 50/50. The other party says he's not going to sell and will let it go to forclosure. How do I stop this. How do I make sure the property is sold and get my 50%. I'm even willing to move in and make timely payments but he refuses to leave. What can I do?

Bring a partition action to have the court compel a sale.
