Legal Question in Real Estate Law in Florida

Judgements

Are judgements the same as liens against property in the state of Florida? My father has a judgement against him and I'm concerned if he sells his house they will take his money.

Re: Judgements

A judgment does not automatically become a lien against real property in Florida. The judgment must be recorded with the Clerk's office in the county where your father has property. Also with regard to his home, if it is homestead property then there are certain protections in place. However, if he sells the home for a profit he could have to pay the judgment from the proceeds.

Tell your father to consult with an attorney to evaluate his rights.
