Has landlord committed fraud?

I signed a one year lease in Aug 08. In Nov. I was served with foreclosure papers on the property indicating that the owner stopped making mortgage payments three months prior to signing the lease. When I would not agree to terminate the lease in Dec08, the owner began to harass me by turning off my utilities. I stopped paying him rent. He has filed for eviction. I was served with a 5 day summons. I responded to the court and requested a hearing with the judge to determine how much I need to deposit into the registry. I did this without an attorney. I alleged in my response that he committed fraud and I was counterclaimimng for damages. Do I have a good case against him? Is it too late for me to get an attorney?
