Legal Question in Real Estate Law in Florida

Landlord ending the lease before the lease period is up

How many days notice in Florida does a landlord need to give a tenant if terminating the lease before it expires? I'm thinking of selling my building, and want to make sure I do it legally.

Normally you sell the building with the current leases and the buyer takes over the leases. Selling isn't a proper basis for terminating a lease, unless the lease provides for it.

A lease is a binding agreement between the parties and neither the landlord nor the tenant can break it before it expires without incurring damages unless there is some sort of provision in the lease which allows for the same.

Generally, a building is worth more with tenants and landlords obtain estoppel letters from the tenants to prove the value of the lease. Most leases require the tenant to cooperate with the landlord in a relatively short term in order to provide this information. A new buyer then takes ownership with the tenant(s) in place for the balance of the lease term(s).

You need to inform the buyer of the lease. When they buy they will be bound by the lease, unless you can make an arrangement with the renters.
