Fannie Mae doesn't do the loans directly. You are correct that it is in the name of a Lender.

However, the Lender sells the loan to Fannie Mae after closing. The Lender may also continue servicing the loan too which would add to your confusion.

You may be able to tell by looking at the mortgage documents and in the bottom corrner it may have some language indicating it is a Fannie Mae/Freddie Mac loan form.

Even if you don't find the language, the Lender still can assign the loan to Fannie Mae (or any other purchaser), which also often happens.

It sounds like you may be in foreclosure on a Fannie Mae backed loan.

You need to state what you are trying to accomplish. Foreclosing banks on Florida property must submit to borrower/loan analysis and mediation to determine if the borrower qualifies for a loan modification. A lawyer can review your loan, and discuss the loan with the bank to determine if you qualify under either H.A.M.P. or H.A.R.P. , both are federal government programs that force the lender to modify the loan if the borrower qualifies.

You need to consult with an attorney right away because this may give you grounds to challenge the lawsuit and the plaintiff's standing. An attorney will have to review your loan documents and the complaint to provide you with specific legal advice. You can also have an attorney help you to negotiate a loan modification with the lender. Please feel free to call me for a free consultation.
