Leak under bath tub in Condo who pays?

I have been notified of a leak that is under the drain out of my bathtub and has damaged the downstairs roof. The Condo that I own was a rental community before and it was sold off to individual buyers. It was sold to me all ready remodeled with a new tub. When my neighbor broke through the roof he found that the pipe was not long enough and it was forced into the drain and over time it has given away and now it is leaking. The association is not accepting any responsibility for this leak and they want me to fix it with in a week or they claim that they will put a lean on my house. All of the information I have been able to gather has lead my to the conclusion that the pipes that are within the walls are ''Common Areas'' and are to be maintained by the association. Is there any truth to this and can there be an admendment to the By-Laws that states that this is my problem.

The drain pipe for your bathtub is your responsibility.
