Legal Question in Real Estate Law in Florida
I lease office space. My rental agreement terms have been a 60 month lease, with option to renew. My existing lease ends May 15, 2012. In May 2007, the new landlord gave me an addendum to the prior lease stating the terms and rate. He did not give me a new lease, but did sign all the pages of the old lease. The old lease stated that upon renewal, the rent could only be raised a maximum of 5%. The landlord is now proposing a rent increase in excess of 65%. I have been told that in the state of Florida, the maximum rent can be raised is 30%. I feel he is bound by the terms of the lease allowing only a 5% rent increase. Can I make him honor the lease agreement?

I would think so depending on what is stated. There is no limit to a rent increase.
