What is the legal definition of adjacent?
My husband and I live on a lake. We have a problem neighbor to one side who has a problem with the ficus bushes we planted for privacy (adding on to the ones he had already planted), our bushes are 15 ft. away from the lake. Our bylaws say bushes adjacent to the lake must be 3 feet and all others 6 feet. In addition to this we are allowed to have a 6 foot fence up to the lake easement which I believe is 7 or 8 feet from the lake. He has trespassed on our property 3 times, hacking our bushes down to the ground ,each time resulting in a police report.

A. Black's Law Dictionary, 6th Ed. defines ADJACENT: Lying near or close to; sometimes, contiguous; neighboring; not widely separated though not always touching.
You obviously can't talk to your neighbor so maybe you can file a request for Citizen Dispute Resolution to resolve this matter. If that doesn't work, you can sue for damages or an injunction. Maybe a letter from an attorney might put a stop to thia BUSH warfare. Have you gotten a Survey to show the location of the bushes on your property? Have you taken this matter to the Board of Directors?
