Legal Question in Real Estate Law in Florida

Legal or illegal kickback?

Hello,

I have a basic question that I am unsure of. Let's say a property management group helps a renter find a place to rent. After the renter has found a place to rent, the property management group wants to give them a $50 reward card for saying ''thank you'' for using that certain property management group. Is this $50 reward legal or illegal? If it is illegal, what is the best way to get around it because I have a website where we are considering giving these $50 rewards to people who use the website and successfully find a place to rent. Would this be legal or illegal? If it illegal, is there a way I could get around it to make it legal? In addition, I have my realtor's license if that helps at all. Thanks for your help!

Re: Legal or illegal kickback?

Check with the Florida Real Estate Commission (FREC) as it may be a violation and jeopardize your license. If they are not a party to the contract and not fully disclosed, it is problematic.
