What are my legal rights and should this be an insurance claim?
I recently had an accident on a friends motorcycle, due to my lack of experience. He has full insurance coverage (collision, liability, comprehensive). He refuses to claim the accident on his insurance in fear of his premiums going up. I agreed completely to pay for the deductible, and possibly the increase in premiums (if any). He got 1 estimate, and signed the work agreement with that person to administer the repair of the bike. He signed the work agreement on his own behalf while expecting me to pay for the full price. His bike is a 1992 Yamaha with 13,000 miles on it. The bike's book value is around $1200. The estimate he got was to repair all blemish problems with the bike, a few that are in question if I even could of caused them. The estimate amount was $1511.00. He's having all new parts to fix the bike, lacking an estimate with used parts. I don't feel this is an appropriate situation and I feel it should be done as an insurance claim. I received personal injury in the process and have hospital bill's in the amount of $1900.00. He is threatening with a small claim. What are my legal rights and how should I pursue this.

He is not obligated to make a claim for the bike damage with his insurance carrier. He can seek payment from you, however, you are only responsible for reasonable repairs caused by your negligence. If you can prove his charges are unreasonable, don't pay it. I doubt his bike had medical coverage for operators.
