Other lesee moved out and left me high and dry

In March 2002 my boyfriend and I signed a 12 month lease on an apartment - I paid one check for last month's rent and security deposit and a second check for the first month's rent. On May 31st, 2002 my boyfriend left the state and I am unable to pay for the apartment on my salary alone as I have a 3 year old daughter to support. I gave my landlord 30 day notice on June 1st as is stated in my lease. The lease states ''no advanced rents or securities will be refunded if move out is less than one full year in this unit.'' It does not say that I am liable to pay the full year's rents. The landlord demanded that I pay the rent for June even though I gave 30 days notice and I paid the last month's rent in advance. She says she is taking me to court. What are my options?

What a nice boyfriend you have. You both are jointly & severally liable which means your landlord collects from either of you or both. If the lease is for a year then you are obligated to pay for a year. If all she wants is the June rent and will give you a written release for any other moneys due I would pay it. Your landlord has a duty to mitigate your damages which means she must take reasonable efforts to rerent the apartment. Suggest you move out so she can rerent.
