Legal Question in Real Estate Law in Florida

lessee renewal rights

When a small Family Business is renting out commercial space, Do we have the right to a 60 day notice from the real estate or management company to move out if they refuse to renew my lease without a legitimate reason especially if i had plans on renewing the lease? We were only given 23 days to try and relocate my business.

Re: lessee renewal rights

The fact that the tenant is a family business is legally irrelevant. What is relevant and controlling is the lease agreement. Review the lease to determine whether the tenant has a right to renew or extend the term of the lease. If the tenant has no such right, then the landlord does not need any reason (legitimate or otherwise) to take back possession and do whatever the landlord deems appropriate with the premises. If the tenant has no right to renew or extend the term of the lease, then the tenant should not have made any plans to renew the lease without first confirming the same in writing with the landlord. Read the lease and good luck.
