Hello,

I purchased a house in Orlando Fl. on June 16, 2001. My mortgage company wanted me to pay off credit card off on or before settlement date. This amount was added to my closing costs. The Title Company was going to forward a check for payoff on this account. The payment has not been received as of today January 1, 2002. Title Company has sent 2 different checks and credit card company has not received any payment. Now late fees and interest are accruing. I have tried to contact the Title Company several times and they will not return my calls. What are my rights? What can I do?

From the limited facts which you have set forth, it appears clear that the title company was negligent in paying off your credit card(s). If they refuse to resolve this problem at this time, your only recourse is to seek legal redress against them.

I sincerely suggest that you meet with a local attorney who is experienced in real estate matters and also will handle small claims. You may ask the Florida Bar for a low cost referral for the initial consultation.
