Lied to by real estate agent

WE were told there was a new air conditioning unit in the house and thatis why we bought it. We found out a year later that the unit is 8-10 years old and it has broken and we don't feel like we should pay for it since we were lied to.

Value of A.C. vs. Cost of Lawsuit

FACTS: Realtor told new air conditioning unit in home; so we bought. Year later found unit was 8-10 years old and had been broken.

Q. Do we have to pay for it since we were lied to?

A. You could possibly sue the Realtor, who probably has an indemnity agreement from the Sellor[s]. You could sue the sellor[s] for misrepresentation, IF this was not an "as is" sale or if you were not given a chance to check out the AC before closing.

Your attorney will need more info. from you and you will have to make a decision as to how much time and money you are willing to spend. In the meantime, get the unit fixed and determine how much money you are talking about so you can make an intelligent decision. Misrepresentation should not be allowed to happen BUT can you afford to draw a line in the sand on this matter. Everyone has the right to go to Court. It is expensive and takes time and energy. It is questionable that you would be fully reimbursed for all your costs and none of your time.
