Legal Question in Real Estate Law in Florida

Lien on home in foreclosure

My condo association placed a lien on my home. My home is in forclosure. My home is not worth what I have on the mortgage and home equity loan. I am also filing bankruptcy next week including the home. Whats happens to the lien? Also can they forclose before the first and second?

Thank you

Kevin

Re: Lien on home in foreclosure

You didn't say which chapter of bankruptcy you rea filing. If you are filing chapter 7, all liens should be discharged, and you won't be responsible for any of it. The condo association is permitted, by the way, to foreclose before the first and second, though they only get their money after the first and second get their money.
