Legal Question in Real Estate Law in Florida

Lien on him am I responsible

I took all the money I had to buy a trailer with land. My credit was not good. I had to get a private lender. I could not get it by myself. My boyfriend at the time signed to help me out. From the begining he knew that it was going to be mine. But now he is giving me a hard time I want his name off of the deed. But he has a lien against him. Would the property that he has his name on be held in acount for his back liens?

Re: Lien on him am I responsible

If the lien is properly perfected against the realty, and the realty is not homestead, then lien would attach. Even if the lien attached you can still have him sign a deed to you. That way you would solely own the realty, subject to the lien.
