Legal Question in Real Estate Law in Florida

Liens on Foreclosure Condo

Buying a Bank Owned foreclosure condo thru auction. Condo Association has Lien on property against the Bank which is current owner for past due HOA fees. Condo Association also paid the current year Property Tax. Auction company claims that all properties auctioned will have insurable title ( no Liens ).

If bought thru auction, could I be liable for any past due HOA fees or Taxes that the Condo Association has paid?

Re: Liens on Foreclosure Condo

The foreclosure should have wiped out all inferior liens. Your title policy should so reflect.
