Life Estate

My step mother does not live at my deseased fathers home. She has let her son occupy the home. This is beach property in Northwest Florida. How do I assume rights to the property. I have a copy o fthe will that states I recieve the property once she no longer resides there.

Having said that, you need to have the will reviewed by an attorney licensed in Florida who will also review records to determine if the will has been probated, which should give you the legal right to be in possession of the home. If the will has been probated and the individual is still in the home, you would need to institute an eviction action. Assuming the will has been probated, thereby establishing your right to the property, you need to contact an attorney in the county where the property is located to pursue eviction procedures.
