Legal Question in Real Estate Law in Florida

I live in a Florida condominium and have water damage in my unit which came from a common element pipe. The bylaws require me to have insurance, which the association does not enforce, and I do not have. Are they liable for my damages.

If you can prove they knew or should have known of the defective pipe they are responsible.
