Legal Question in Real Estate Law in Florida
We live in Florida. We recently went into a contract with a buyer (through a realtor) to purchase our condo. The buyer lives in Canada and left a $5,000 payment and signed the contract as did we. He now is backing out and is covered by the 3 day recision law. In our contract addendum the box where it speaks about the recision is not initialed by either the buyer or seller. My agent says that his discount has to be returned to him.

Realtor is right. If a box wasn't checked then Buyer wins. This provision by law cannot be waived by the Buyer, even if they want to. It's an absolute protection to the Buyer.
