How long does an appeal in circuit court take, Broward county?I am suing my co-op and the judge allowed the opposite lawyer 1hr and 20 min to my attorey 20 minutes. The co-op Board stole the common area from the unit owners so only board members and former members where allowed to build and sell docks claiming they are included with their unit so their unit is worth more. It is totally against the governing documents but the Board ignored the by-laws. I started suit and the opposing board lawyer kept putting motions to dismiss and my attorney had to amend the complaint each time. The judge was retiring 2 weeks before the end of 2012 and dismissed the case with prejuices. I appealed. I found out the Board did not have insurance so all the unit owners had to pay all the legal fees . In the end of the year buget statements they claimed they paid insurance for the 3 years ( it was listed on the budget statement) I have now asked to see the accounts payable for the insurance that was paid out to the insurance company. A circuit court appeal, from a county court order? There are time frames for filing the record and briefs that have to be followed. If the matter is then set for oral argument, it is up the Court to determine that. After that all occurs, the Court can take the matter under advisement for as long as it wants. There is no specific time frame within which the Court must rule. An appeal from the circuit court to the appellate court follows the appellate rules and has time frames for the record and briefs and then the Court can rule in its own timeframe.
