Do not want to lose rights to homeownership

My ex husband and I purchased a house together AFTER we were divorced. We lived together for three years after the purchase. I am planning on moving out of the house as the relationship is not working out. I would like for the house to be sold. Do I loose any rights as the owner if I move out before the house is sold? Also, can he refuse to sell the house? He is planning on staying in the house until it is sold. Thank you.

You lose nothing by moving out. An action in partition will force a sale.

If you're one of the owners on the deed/title to the property, moving out will not terminate your interest in the real property. You may need to file a partition action if your ex-husband decides not to sell or in any way poses a threat to your interests. Good luck.
