Manufactured Home sold as Modular

We bought a home in Florida 3 years ago. We were unable to refinance because the deed is wrong. We thought we were buying a modular home but it is manufactured which has less value. The deed states modular and then shows the manufactured homes VIN number. Do we have any recourse against the builder/seller. His partner is the attorney who did the closing and is holding our second mortgage. The home is on the market but the lender told us we probably will not be able to sell it.
