There are really two issues here. First there is the contract issue. Marital status is not an issue relevant to a purchase agreement (unless for some odd reason there is a clause that addresses this issue). So, no, a person does not have to disclose their marital status within the purchase agreement. Second, though, is the issue of who may have an interest in the property.
