Legal Question in Real Estate Law in Florida

Mediation: Foreclosure

We have a court mediation in 3 weeks for prevention foreclosure.

We have not made morgage payments since May, 2008. I have been an unemployed since April, 2008, and my wife is Social Security Disability. We have no way of making monthly mortgage payment even though the lender offer significantly lower payment plan. Well, if any monthly payment will help saving our home, then we may try $100/month payment.

The question is how should we face the upcoming mediation? We can not foreclose our house, we have no way of renting apartment, thus force us to go homeless? Is the court mediator has a sense and strong opinion of understanding our situation? Forcing diability person to throw out of the house? U.S. government is discouraging for lenders to exercise foreclosure, as you know. Do we have a chance of avoiding foreclosure?

Thank you,

not is all you can pay is $100 per month. The lender is entitled to be repaid. You borrowed the money. I know it is a hard place, but you need to try to find work and find a place to live that you canb afford.
