Legal Question in Real Estate Law in Florida
I'm a member of an HOA Violations Committee. A resident was cited for a street-parking type violation last year, and the violation was discharged because the board had no photographs of the issue. A few months later, the Board of the village modified the parking code to make it more strict. The offending resident was recently cited for violating the newly passed parking restriction.
Q: Is this new violation considered a second infraction of the offense, or a first violation of the newly adopted by-laws regarding street parking?

First. To be a second you would have had successfully found her guilty of the first charge. Instead you dismissed it so she was found innocent and is not a repeat offender.
