Mice infestation in the apartment

Last night I discovered that mice have infested my 2nd floor apartment. This morning I notified the landlord of the problem, and they informed me that a pest control person would be on the premises this afternoon to take care of the problem. Given the prior performance record of this landlord, I sincerely doubt that will happen. I want to know what are my rights as a tennant to vacate the apartment without the apartment complex suing me? Do I have a case to sue them if they resist to let me out of the lease without having to pay lease break fee?

Read your lease. Their should be a provision covering pest control. If they cannot cure the problem you should be able to terminate the lease.
