Legal Question in Real Estate Law in Florida
mngr threating to increase rent if ac needs replacing
Hi there,
I live in an apartment complex and recently my apartment ac unit stopped cooling. Apparantly I found out that this ac unit has had several problems in the past and is an old 1978 model. My landlord sent someone to fix it but after a week the problem came back. To get another opinion I had a friend of mine(certified ac repairman) look at the AC and he said that it has not been cleaned in a long time, has a gas leak and basically it needs to be replaced with a new unit because it is too old and worn out. Anyways I advised my landlord of this and he threatened that if he has to replace the unit he will HAVE TO raise my rent. I know this has to be illegal but I want to know what can I do at the moment and or after he does raise my rent.
Thank you I appreciate your time.

Rental increase if AC replaced
In Fla., rent is fixed in your written lease for the term of the lease. If you are not on a written lease, then the landlord can give you notice of a rent increase for whatever reason, excluding discrimination. If it costs a landlord more to run the apts., then the rent will likely go up.
