Legal Question in Real Estate Law in Florida

Mortgage

My mortgage with Countrywide is $815.00 a month. I am only working part time, so I end up paying after the 16th (but before the next month is due). Last month I had a situation that cost me $400.00. I sent CW $700.00. They sent me certified mail a Notice to Accelerate (plus a $100 late charge). My mortgage is not behind. Can they legally do a Notice to Accelerate?

Re: Mortgage

They cannot accelerate the loan if they accepted your partial payment. If they sent back your partial payment, they can accelerate the loan.
