Does a mortgage servicing company that buys a mortgage during a lawsuit assume the past mortgage. Companies liability? Or is it like buying stolen property?

The purchase the rights and entitlements to the mortgage. They are not liable for actions of the prior company unless they form defenses to the mortgage itself. Not sure what your reference to stolen property even means. Seek legal guidance with all your paperwork
