Legal Question in Real Estate Law in Florida

My mother passed away last year. She owned a co-op in a 55 and older community in Hallandale florida. My mother wrote her own will and had it notarized. She left the apartment to me and my two brothers. What is the procedure to get the paperwork in our names so that we can sell the apartment? All three of us are under the age of 50 and we have no desire to relocate to Florida and do not want to keep paying the maintenance fee.

If it is solely in her name, then it needs to be probated. I would have to examine the Will is valid. You will be required to use the services of an attorney to do if probate is required.

If she lived in Florida, her will must go to probate here. A personal representative will be appointed with authority to sell. I can assist you should you need counsel and realtor. Good luck.
