Motion to Dismiss denied

I filed a motion to dismiss the lis pendis due to plaintiff not being real party in interest. I completely missed the hearing and not knowing what to do I let time pass. 5/12/09 the order to deny was issued. What can I file now? Can I answer the complaint?
