Legal Question in Real Estate Law in Florida

MyMother'sHouse

My mothers house is left to me as an only heir when she dies. It's only in her name now, should I change that (she has alzhimeres) and put in my name only or both our names? Can the state take the home if it's in my name to pay the medical bills

Re: MyMother'sHouse

It may depend on whether you are living in the house or not. If it is the place you are living in then it may be subject to any homestead exemption granted by Florida if it is you primary residence. If the house passes as part of the estate then it may be sold to pay her creditors including her medical bills.
