Legal Question in Real Estate Law in Florida
Neighbor began and dropped Property line dispute now selling home
About two years ago my neighbor
began a property line dispute via her
lawyer. We went back and forth, offered
to draw up agreement that property line
fall along fence. Never heard another
word from her or her lawyer. Now she
is selling her property, but we still have
this issue unsettled. If I contact her
lawyer, will it prevent her from selling?
I would like this issue solved once and
for all, how should I proceed? (She is in
foreclosure and perhaps a little
desperate)

A survey should resolve the matter. In any event, the buyer will have the same problem.

this does not sound good.If your neighbor is in foreclosure she is probably in a panic.I doubt anyone has mentioned to the buyer this situation because the seller(or her agents) would have a duty to disclose this situation.(which could kill the sale). If you disclose this to the buyer and the sale does't happen the selller could sue you for interefence with the contract.I would suggest you e-mail me how to reach you or call me at my office to discuss this matter further.
