Neighbor wants to ''take possesion'' of my mom's property

When a new neighbor moved next to my parents, he tried to build a dock into the canal. My parents own the canal, so my father put up a fence. He had the property surveyed to show the neighbor it was my parents property. (About 3 years ago). My father has since passed away and my mother just noticed the neighbor taking down the fence. She confronted him and he told her he was going to build a dock. She called the police. After talking with the neighbor, the police man told my mom that the neibor said he was going to ''take possession'' of that piece of property.

Can one do this? What is my mom's next step? She does not have the money for an attorney, unless that is her only hope. Please help.

If he uses the property he will be trespassing. Your mother may then seek certain legal remedies for which she will need legal counsel.
