neighbors fence on my property line

Hi

We have a brand new home being set on new property. My neighbor has a broken down stockade fence right on my property line. I have a survey to prove it. I asked him when I introduced myself and he became very aggitated when I asked him about it. I wish to put my own fence up and cant because of this broken down fence. It is directly on my line. What can I do.

I logged a complaint with orange co. code enforcement. I was advised to get a lawyer. We dont have any money for a lawyer because this new house a property is costing every dime we have. I dont want trouble I just want to know what my legal rights are.

If the fence is on your property you have a right to have encroachment removed. If it is on the line,it is still partially on your property but first you should review your zoning codes, which should supply the answer. Normally there is a setback requirement. But best is that you consult with a competent real property atty in your locale. The consultation does not require that you retain his services.
