Neighbor's Tree

My neighbor has a tree very close to our property line. The tree has many dead and dying limbs. In the event that the tree limbs fall and damage my home, is my neighbor responsible? Can I trim the tree so the limbs will not fall on my home? Is it neglegence on my neighbors part if she does not get rid of the dead and dying limbs? We have told her about our concerns and possible damage to our home and she does not want to take the tree down. Do we need to give her written notice of our intent to trim the tree?

1. Yes, you can trim limbs over your property.
