my neighbors tree is overhanging my driveway and scratching my car can I saw off the offending limb, talking with him gets me nowhere

Normally you have the right to trim a tree limb that is coming over your property line.I would make sure you incorporate your neighbor in the process. You would be responsible if the trimming did harm the tree, so be careful.
