Legal Question in Real Estate Law in Florida
I am a novice real estate investor who would like to try bidding in an online foreclosure auction. I have done my due diligence and see that there is a second mortgage on the property. Yet only the first mortgagee has brought the action and won the judgment. If I am the winning bidder, what is my liability to the second mortgagee. Can I get clear title. A similar situation is if a Condo Association has brought the action and won the judgment. Can I get clear title if there is a mortgage on the property?

Novice is not a good place to be in that world. You need to research the underlying action to determine who, if anyone, was included in the action and who was wiped out by the Judgment. Time to hire an attorney assist you in this venture. The judgment can only wipe out those liens included in the suit which were inferior.
