opinion of title

can a real estate broker/salesman write anopinion of title, or only an attorney?

Any licensed title agent can issue a title commitment and a subsequent title insurance policy after the deed has been recorded. To the best of my knowledge, only an attorney can issue an opinion of title.

Regardless, why would you want an opinion from anyone other than an attorney? An attorney has the benefit of a law school education and has passed the Florida Bar. He or she possesses the requisite knowledge to properly handle your transaction. The fees will not be any cheaper to have a real estate matter handled by a non attorney but the level of skill will be far less. You have nothing to gain and everything to lose.

As a practicing real estate attorney, I cannot begin to describe the horrors that I see from title work done by title agencies without the benefit of an attorney. I spend countless hours cleaning up their mistakes or suing for their errors.
