Legal Question in Real Estate Law in Florida

I painted a condo and was told he would pay me at least $300 a room and miscellaneous charges he has refused to pay me anything even though a new tenant has moved into the condo. I have filed a claim with small claims court but is his refusing to pay against the law ie:theft of services?

It is a civil matter not likely going to get police and state attorney to pursue criminal charges.
