I and my ex boyfriend bought a home together. We broke up and

I want to know how much it would cost to ''partition'' the home, in

case he doesn't want to sell it.

Unfortunately, there is no simple answer. The filing fee is approximately $256.00. Service of process is approximately $25.00 per person. The legal fees would depend upon how much your attorney's hourly fee is and how many hours are spent litigating this file. This is dependent on how vigorously your ex boyfriend fights you on the partition action.

Your attorney can ask the court to make an award for both the court costs and attorney's fees thereby forcing your boyfriend to at least share the burden with you. The payment could come off the top of the sales proceeds if the home is sold on the open market. Don't be afraid to meet with several attorneys and "shop around" in order to find an attorney you are both comfortable with and whose fees are reasonable to you.
