Legal Question in Real Estate Law in Florida

partition and renter

I am starting a partition action with a house that is being rented by the other owner, not known to me until recently. He has a three year lease and I understand that has to be honored but I receive no money, nor did I sign the lease. Can I force the other owner to pay this guy off so I can sell this house in a timely manner? Do I have any other options?

You will be able to ask for relief in this action, is the house in FL? The house CAN be sold and most likely will have to be sold unless the other guy wants to buy you out at fair market value. You should receive $ for your 1/2 of the rent minus costs he pays realted to the rental. The new owners will have to honor the lease which will decrease the market value to some extent.
