Legal Question in Real Estate Law in Florida
Paying fees on the rent check my landlord lost
I have a carbon copy of my rent check as well as a witness to verify that I dropped off my rent check. They notified me of my missing check after they tacked on a $50 late fee (because they couldn't find it). I also had to cancel the original check and issue them a new one. I was charged $29 for canceling my check. I feel I should not have to pay for any of this, considering I dropped the check off on time and was not responsible for it being lost. Do I have the right to getting my money back? Even if I wasn't given a receipt? Please help me!!

Re: Paying fees on the rent check my landlord lost
Technically you can obtain your money, but practically it's economically a loss. Your best bet is to try to adjust the matter with the landlord. Bring your witness with you to the discussion. If you wish, you can sue for the money in small claims court. The amount involved does not warrant the retention of counsel.
