police say I cannot go on my property

My tennant left out oweing 7mo rent and utilities and has left some personell belongs in the house and the house un secured, I was told i cannot go there until she has has all her belongings out,going on 2 weeks now,they say if I go there she can have me arrested, how long can she take to remove her belongings,it was furnished and she has threatned to take all my things, and do bodily harm to me and damage my property.

Please help...thank you

Hm. furnished and tenant threatned to take all my things, and do bodily harm to me and damage my property.

A. You received "Bad Legal Advice". You should immediately inspect your property. If abandoned by tenant, then remove belongings and put in storage; secure property and fix for rerenting. An owner always has the right to protect their property and CAN'T be arrested for doing so. This is a Civil matter; not Criminal! The police should tell your former tenant to get a lawyer and go to court. Police are there to prevent a Breach of the Peace only; NOT to decide peoples' rights; that for the Judges.

Need more information. For example, is there a

written lease agreement. How much has she paid

you in rent and for what period of time. What other

evidence is there that she has abandoned the property?

I strongly suggest you seek the advice of an

attorney experienced in these matters. A lot of

what other people tell you may be true or may have

occurred in other situtations, but there may be

something different about yours which makes the

outcome in the other cases inapplicable to yours.
